Gender equality in the workplace remains a crucial issue that shapes policies, workplace culture and legal standards in Bermuda. 

But what does it really mean for employees and employers?

Kelly Francis leads a group of professionals that help businesses stay informed about “evolving laws and the best practices to foster fair and inclusive workplaces”. 

With guidance that covers everything from equal pay to anti-harassment policies, the team at Performance Solutions Ltd helps employers avoid mistakes and ensure equitable treatment for all employees. 

This marks a stark contrast to 1944. Women had only then earned the right to vote and their employment opportunities were limited to domestic and clerical work, teaching and nursing. When women began entering more professional fields in the late 1960s, pay disparities and workplace discrimination were common. 

A major turning point came in 1981 with the passage of the Human Rights Act. 

“Bermuda has made significant strides in addressing gender equality through key legislative updates and policy initiatives,” explained Ms Francis, managing director of Performance Solutions. 

“The Human Rights Act prohibits discrimination based on sex, sexual orientation, pregnancy, marital status and family status. 

“This means that hiring, promotions, pay structures, and workplace treatment must be free of bias.” 

New laws help level the playing field 

In June 2021, amendments to the Bermuda Employment Act required all employers to implement written policies against bullying and sexual harassment. 

“These policies must be shared with employees upon hiring, and businesses are expected to provide training to ensure compliance,” Ms Francis said. 

“Employers who fail to meet these requirements risk legal repercussions, including complaints filed with the Human Rights Commission.” 

The establishment of the Gender Affairs Council in 2023 was another notable step toward levelling the playing field. 

For the past two years the group has been “actively reviewing gender-related policies, including workplace equity, gender-based violence, and pay disparity”. 

The efforts align with Bermuda’s commitment to the United Nations Convention on the Elimination of All Forms of Discrimination Against Women, Ms Francis explained. 

Here is a list of essential actions that Performance Solutions considers key for businesses that want to stay aligned with evolving standards: 

  • Review and update policies: ensure workplace policies comply with anti-discrimination laws and that all employees are aware of their rights. 
  • Conduct pay equity audits: regularly assess and correct gender pay gaps to promote fair compensation. 
  • Provide gender sensitivity training: educate managers and employees on workplace biases, inclusive communication, and respectful behaviour. 
  • Enhance work-life balance measures: introduce flexible work arrangements and family-friendly policies to support employees with caregiving responsibilities. 
  • Strengthen reporting mechanisms: establish confidential channels for employees to report harassment or discrimination without fear of retaliation. 

“Bermuda’s ongoing efforts to advance gender equality signals a growing emphasis on workplace fairness and inclusion,” Ms Francis said. 

As the Gender Affairs Council continues to push for reforms, employers must be proactive in aligning their practices with legal and social expectations. 

“Employers who take these steps now will be well positioned to navigate future changes while strengthening their company culture and employee morale.
